Darshan Bail Cancel by Supreme Court Orders Immediate Custody

The Supreme Court of India has today cancelled the bail of Kannada actor Darshan Thoopudeepa. He is accused of being involved in the murder of Renukaswamy (33), a 33-year-old fan, after he was kidnapped and assaulted. This decision by India’s top court overturned a previous ruling of the Karnataka High Court.

Darshan was taken into custody by a bench consisting of Justices JB Paradiwala and R Mahadevan. Justice Mahadevan criticized the Karnataka High Court for its handling of bail decisions, calling them a perverse exercise of judicial authority that had fundamental flaws. The Supreme Court emphasized that bail decision lapses were “unacceptable” and called for more caution.

Justice Mahadevan noted that “we considered both the grant and cancellation of bail, and it’s evident that the order of the high court reflects an exercise of mechanical power.” Granting bail can influence the outcome of the trial and even the testimony.

Justice Pardiwala also praised the judgment, acknowledging Justice Mahadevan’s contribution. He stated, “Justice Mahadevan pronounced an extremely erudite judgment.” This is a judgment that cannot be described. “It sends the message that no matter how big or powerful the accuser may be, they are not above the law.”

The apex court’s comments against the concerns that Darshan was receiving VIP treatment while in jail led to this decision. Images of the actor relaxing in a chair, holding a coffee, and smoking a cigarette were released earlier. Justice Pardiwala, in response to the allegations, issued a strong warning about any treatment of this kind. He stated, “The moment we learn that accused people are receiving five-star treatment… the first thing I will do is suspend the superintendent along with other officials.”

Renukaswamy’s father, Kashinatha Shivnagowdaru, welcomed the Supreme Court’s decision and expressed renewed confidence in the judiciary. Darshan’s legal defeat is a notable example of how the justice system has reframed accountability and rejected actions that might compromise fair trials.
