Supreme Court Lawyer Suspended Immediately after the Attack on Chief Justice

The Bar Council of India suspended Supreme Court Advocate Rakesh Kishor with immediate effect after he attempted to attack on Chief Justice BR Gavai in court on Monday. This unprecedented event has shocked the Indian legal profession.
Chief Justice Gavai was attacked during a regular hearing by advocate Kishore, who attempted to throw a shoe towards the judge. The security personnel intervened immediately and led the lawyer from the courtroom while he yelled, “India won’t tolerate insults to Sanatan Dharma.”
The Bar Council of India took swift action to correct this grave breach of courtroom decorum. The Supreme Court Advocate is prohibited from acting, appearing, pleading, or practicing in any courts, tribunals, or authorities across the nation. Kishore is prohibited from engaging in legal work while the disciplinary process continues.
This attack against Chief Justice Gavai came just a few weeks after the legal and public community criticized the Chief Justice over his controversial comment, “go ask the god itself,” during a hearing about the restoration of damaged Vishnu icons in Madhya Pradesh. The lawyer seems to have been triggered by the earlier incident.
Chief Justice Sanjiv Khanna, who presided alongside Justice Vinod Chandran despite the disturbance caused by Chief Justice Gavai’s attack, kept his cool and carried on the proceedings uninterrupted. The judiciary is committed to preserving order and dignity during court proceedings.
Kishore has been given 15 days to reply after receiving a notice from the Bar Council of India. Kishore must respond within 15 days of receiving the order, explaining why the suspension shouldn’t continue or why any further disciplinary actions should be avoided. Delhi’s Bar Council has been instructed to implement the suspension immediately. This includes updating the status of the advocate on the official rolls and notifying all courts and tribunals under its jurisdiction.
The attack against the Chief Justice is a grave violation of professional ethics and courtroom behavior. In India, the legal profession is governed strictly by codes of conduct that require advocates to maintain dignity and respect when appearing in court. These incidents are unacceptable and undermine the integrity of court proceedings.
Bar Council of India’s swift response sends out a strong message to the public that any attack on an official of the judiciary will have severe and immediate consequences. The legal community condemned the incident strongly, stating that disagreements over judicial decisions must be resolved through legal channels and not physical confrontations.
In order to avoid future incidents, the Supreme Court is reviewing its security measures following the attack against Chief Justice Gavai. This incident highlights the importance of enhanced security protocols in order to maintain peace and tranquility during court proceedings.
The Bar Council of India was established in 1961 under the Advocates Act. The Bar Council of India maintains standards for the legal profession, regulates education in law, and takes action against those who break professional conduct laws.
